Insurance Coverage & Bad Faith
The firm is regularly retained by insurers faced with coverage questions under first and third party policies. We have particular expertise in specialized maritime and transportation coverages, and with the California Insurance Code and Claims Regulations. We advise admitted and non-admitted insurers, TPA’s and cover note holders, and address coverage questions arising under CGL, MGL, Cargo, Hull, P+I, Freight Forwarder, Property, Marina, and Pollution policies, among others. We also defend Underwriters against lawsuits alleging breach of the covenant of good faith and fair dealing.
Maritime Casualty & Personal Injury
The firm maintains a substantial maritime casualty practice, including disputes involving charter parties, tug & tow, salvage, collision, and general average. Gibson Robb & Lindh LLP regularly defends maritime and non-maritime personal injury and death actions, including actions arising under the Jones Act, Section 905 (b) of the Longshore & Harborworkers Compensation Act, Death on the High Seas Act, General Maritime Law and recreational marine and marina accidents. Commercial Disputes
The firm possesses significant experience in assisting domestic and foreign clients with resolving commercial disputes, including prosecuting and defending such matters in both judicial and arbitral forums. Representative disputes in this area include purchase and sale agreements, distributor and franchise contracts, service contracts, charter parties, construction contracts, and a variety of other matters.
Product Liability & Asbestos Defense
